THE CLIENT
1. We authorise Olia Photography to arrange the photography of our Wedding, in accordance with the details overleaf.
2. We have received, read and understand price list of Olia Photography, which has been confirmed for our Wedding, on payment of the deposit/booking fee. We agree that payment of the initial deposit/booking fee confirms the booking with Olia Photography as per the details shown in the front of this order.
3. We agree to pay the full balance at least two weeks prior to the Wedding Day. Failure to do so gives Olia Photography the right to refuse to carry out the full photographic services.
4. The booking of and any additional costs incurred for booking venues, photography locations etc are our responsibility and may be deducted from the photographic coverage unless paid for separately. (NB If the photographer is required to remain after the meal, a meal should be provided by the Bride and Groom.)
5. (a) We are satisfied that the details overleaf are correct and will confirm the details prior to the Wedding. We agree to advise the hairdressers and make-up artists, the hire cars and the caterers of all the relevant times, details and locations as detailed here and to coordinate their services.
5. (b) The details & times listed form part of this agreement and we agree to make every effort to cooperate in order for Olia Photography to fulfil its contracted photographic duty. We acknowledge Olia Photography cannot accept responsibility for the ‘extent’ of the photographic coverage if these details are incorrect or if we chose not to follow the agreed to schedule.
6. We accept that the photographer provided by Olia Photography will be the only professional photographer at our Wedding. To avoid disruption to the photographic coverage and to allow Olia Photography to fulfil its contracted duty, other photography and videography by family and friends will be at the discretion of Olia Photography’s photographer. Photography and videography by the wedding guests are accepted for casual, personal pictures, as long as they do not conflict with, copy, or delay the work of the main photographer.
7.(a) We accept the responsibility to contact Olia Photography, at least two weeks prior to Wedding, to confirm details are correct and there are no alterations.
7.(b) We acknowledge that if a second photographer is included in the quote, we are required to confirm the booking and coverage time no later than two months prior to the Wedding date. Failure to do so may result in the second photographer not being provided on the day.
8. We agree to immediately advise Olia Photography in writing of any alterations in the details listed here including postponement or cancellation of the Wedding.
9.(a) In the event of cancellation of the Wedding we agree that the non-refundable deposit will be forfeited and cannot be claimed towards other photographic services. For the remainder, Olia Photography may allow a claim towards other photographic services only in cases of genuine hardship, within twelve (12) months of the cancellation.
9. (b) In the event of postponement of the Wedding for a period of more than 6 months from the original Wedding date, we agree that the pricing and packages may be subject to change.
10. (a) We agree the Copyright in all photographs is owned by Olia Photography. We give permission to Olia Photography to use any image of our Wedding for industry competitions and as required subsequent usage and for reasonable general promotional advertising for Olia Photography. The usage for any other purpose is to be renegotiated between the parties and requires specific permission.
10. (b) We understand that the images created by Olia Photography are for our personal use only. They are not to be used for any commercial purpose by us, our guests and vendors. Any commercial use has to be renegotiated with Olia Photography.
11. We acknowledge that, if included in the package, the complimentary engagement session
will be captured at least 4 weeks before the wedding day and will be held on a weekday. We also understand that the session is non-refundable, non-transferrable, cannot be exchanged for cash and cannot be used towards any other photographic services. Should we fail to organise the engagement session before the wedding day, we accept that the engagement session will be forfeited.
12. We acknowledge that, if included in the package, the complimentary print credit or the wedding album set has to be redeemed within 12 months after the wedding day. We also understand that the print credit or the wedding album set is non-refundable, non-transferrable, cannot be exchanged for cash and cannot be used towards any other photographic services. Should we fail to confirm and place our order within 12 months after the wedding day, the print credit or the wedding album set will be forfeited.
13. The negatives/digital files remain the property of Olia Photography and will be kept on file for a period of 12 months.
14. Regarding ordering photographs from Olia Photography, we understand that:
14. (a) The wedding will be considered one Order, regardless of how many individual parties request photographs. We will be responsible for the entire order and no partial orders will be given out until the balance of the Order is paid.
14. (b) All orders including family and friends’ orders are to be placed within eight weeks of viewing of the proofs, otherwise prices, assortment and inclusions current at the time of ordering will apply.
14. (c) All orders must be accompanied by full payment unless prior arrangement with Olia Photography had been made.
14. (d) Should we fail to pay and collect any order within fourteen (14) days of notification of completion, the order shall be in default and Olia Photography shall charge a default charge of 1.5% per month (18% annual rate) on the unpaid balance (minimum monthly charge of $5.00). In addition, we acknowledge that no future orders will be processed until the Order is paid in full.
14. (e) All orders shall remain the property of Olia Photography until full payment has been made.
14. (f) Telephone orders require written confirmation with payment before the order can be processed.
14. (g) All reasonable freight and postage which we request, will be paid by us.
15. We acknowledge that the original digital files will be kept by
Olia Photography for a period of 12 months after which time they may be purged from the system.
16. We understand it is our responsibility to download the digital files supplied by Olia Photography within 3 months after being received by us. We agree that if there are any issues with the supplied digital files, we will advise Olia Photography in writing within 3 months. We also understand, it is our responsibility to organise storage and back up for the digital files supplied.
OLIA PHOTOGRAPHY
1. Should nominated photographer not be available for any reason, Olia Photography will notify the Client of the change as soon as it is known and provide a refund or another photographer with equivalent skills.
2. Olia Photography shall carry out this assignment with due and professional diligence. Elements beyond Olia Photography’s control include faulty material, equipment failure, damaged and exposed film, loss of film/photos/ negatives/digital files in transit between Olia Photography and professional laboratories employed by Olia Photography, loss or damage to film, negatives/ digital files and proofs during processing and developing either by Olia Photography or professional laboratories employed by Olia Photography, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent Olia Photography completing in whole or in part this assignment. In this case Olia Photography shall not be liable for its complete performance of the assignment. It is agreed that the liability of Olia Photography shall be limited to be a refund of any money paid under this agreement which shall be in full & final satisfaction of any damage or loss suffered.
3. Olia Photography currently holds $5 million Public Liability insurance and equipment insurance.
4. (a) Digital images are supplied via email (online delivery) within 8 weeks after the Wedding Day. The client will receive access to the online gallery for 3 months to download the files. If the client requires a fast turnaround of images, i.e. within 24 hours, additional rates may apply.
4. (b) Olia Photography exclusively chooses the photographs to be sent to the client.
4. (c) Digital photographs are provided in JPEG format in sRGB colour space in 2 sets: one set in low resolution (96ppi) for social media and another set - in high resolution (300ppi) for printing up to A3 size.
4. (d) All digital images are edited to the photography industry standards including: exposure, contrast and white balance. If the client requires any additional edits or removal of details, additional fees may apply.
5. If the package includes a USB drive, a keepsake box, albums or prints, it will be delivered within 2 months after the order is confirmed by the client. Delivery within the ACT and 30km around the ACT is complimentary. Any postage outside of this area and any special packaging will be charged additionally to the client.
6. In the event the photography coverage required extends beyond the agreed time then an additional fee of $225/half hour will be charged.
7. Olia Photography has no control over the environment in which the printed photographs are kept. We acknowledge that printed photographs, in common sensitised material and colour dyes, have limited life expectancy when exposed to strong and prolonged sunlight or fluorescent light sources. Photographs will retain their colour and brilliance much longer when displayed under better lighting conditions. Olia Photography accepts no responsibility for damage caused by the environments where the photographs are kept.
8. Olia Photography shall not be liable for the quality of printed photographs if the photographs are not ordered through Olia Photography.
